This Agreement, including its formation, interpretation and enforcement, shall be governed by and construed in accordance with the laws of the People's Republic of China. Any dispute or controversy arising out of or in connection with this Agreement shall be submitted to the people’s court in the jurisdiction where Xiamen RediSail Creative Network Technology Co., Ltd. is located.

1.2 Upon successful registration, the Platform shall activate the User’s account based on the User’s objective need for utilizing the services provided by the Platform. The User shall have the right to access and use the Platform's services upon activation of the account by the Platform, which shall agree to provide such services to the User. The User further agrees that:

RediSail Copyright Policy

The User shall assume full responsibility for his actions while using the Platform’s services, for any content he publishes or discloses through the Platform, and for all consequences arising from such actions.

The User acknowledges that any information submitted, published or displayed by the User will be visible to other users of the Platform and to third-party services or websites. (The User may control the visibility of his information by adjusting Settings within his account, including determining which account types can access their information.)

Unless otherwise expressly stated by RediSail, all intellectual property rights (including but not limited to copyrights, trademarks, patents, trade secrets, and all other proprietary rights) pertaining to all products, technologies, software, programs, data and other information made available on the RediSail platform (www.weiyun001.com) (collectively, the “Platform Content”), including but not limited to text, images, graphics, photographs, audio, video, charts, color schemes, layout designs and electronic documents, shall vest in RediSail or its affiliates. No individual or organization may use (including but not limited to the use of robots, spiders and other automated programs or devices to monitor, reproduce, disseminate, publicly display, mirror, upload, download or otherwise exploit) any Platform Content without the prior consent of RediSail.

The names, logos, trademarks, and service marks of RediSail, including but not limited to “RediSail”, “weiyun001” and “witranscn”, as well as any related designs, graphics, or combinations thereof (collectively, the “RediSail Marks”), are trademarks or registered trademarks of RediSail or its affiliates in China and other jurisdictions. No individual or organization shall use, reproduce, display or otherwise exploit the RediSail Marks in any manner without the prior written authorization of RediSail, nor shall any individual or organization represent or imply that they have the right to do so.

1.5 The Platform reserves the right to delegate its rights and obligations under the Services or this Policy to its affiliates or other third-party service providers for operational, managerial and performance-related purposes, without the need to obtain separate authorization from the User. The Platform will use its best endeavors to minimize any inconvenience to the User resulting from such delegation or changes. The Platform will notify the User, as applicable, via the website, platform, SMS, email or other appropriate channels in a timely manner. For the purposes of this Policy, “Affiliate” shall mean any entity that controls, is controlled by or is under common control with the Platform. “Control” shall mean the direct or indirect ownership of more than fifty percent (50%) of the voting rights or management control of such entity.

2.1 The specific scope of services offered by the Platform shall be determined by the Platform based on actual circumstances. Such services include, but are not limited to, granting the User access to his account for the purpose of publishing opinions, posting comments, sharing links and other related activities. The Platform reserves the right to upgrade or otherwise adjust the form of the services or products provided. Any such changes will be promptly communicated to the User via webpage updates or system notifications.

2.2 Certain services provided by the Platform are paid services. In order to access these services, the User is required to pay applicable fees to the Platform. For such paid services, the Platform will generate clear prompts prior to use. The User may only access these services upon providing confirmation of his willingness to pay the specified fees. Should the User refuse to pay the requisite fees, the Platform reserves the right to deny access to such paid services.

3.1 Considering the inherent nature of online services (which may include, but are not limited to, issues such as server instability, malicious cyberattacks, or other circumstances beyond the Platform's control), the User agrees that the Platform reserves the right to suspend or terminate, either partially or entirely, any of the Platform's services (including paid services) at any time. In the event of such suspension or termination, the Platform shall make reasonable efforts to notify affected users in a timely manner through web announcements, system notifications, private messages, SMS alerts, or other appropriate means. In the event of suspension or termination of paid services due to reasons attributable to the Platform, the Platform shall refund any remaining virtual currency to the User’s virtual currency account or provide an equivalent alternative paid service to the affected users.

3.2 The User acknowledges that the Platform may, from time to time, and either periodically or on an ad hoc basis, perform necessary maintenance or repairs to the platforms (such as websites and applications) or associated infrastructure. In the event that such maintenance or repairs result in an interruption of services for a reasonable duration, the Platform shall not be liable for any damages or losses incurred. Notwithstanding the foregoing, the Platform will use commercially reasonable efforts to provide advance notice to the User where possible.

3.3 The Platform reserves the right, at its sole discretion, to suspend or terminate the provision of any and all services hereunder (including both paid and free services) to the User without liability to the User or any third party under the following circumstances, and the User shall bear full responsibility for any losses resulting therefrom:

The User provides false or misleading personal information;

The User breaches any applicable laws, regulations and national policies or the terms of use set forth herein;

The User fails to remit the required payments for paid services as stipulated;

The User engages in activities that infringe upon the legitimate rights of individuals, social organizations, businesses or public institutions, including but not limited to insulating, slandering and abusing individuals or damaging the goodwill or reputation of social organizations, businesses or public institutions;

The User damages the reputation or image of regulatory authorities, government bodies or agencies;

The User, by any means, damages the reputation, goodwill or legal rights of RediSail or its affiliates;

Any other situation where the Platform determines it is necessary to suspend or terminate services to the User.

4.1 The User may edit his registration information, including but not limited to the account name, nickname, avatar and profile description (hereinafter collectively referred to as “Account Information”). However, the User agrees to adhere to the “Seven Fundamental Principles” and relevant regulatory provisions, and undertakes not to include any illegal or inappropriate content in his Account Information. Upon registration for a RediSail account, and in connection with the creation, posting or distribution of content, the User is expected to provide accurate and truthful identity information and personal data. The User may not register using false, fraudulent or misappropriated resident identity information, corporate registration details or organizational codes. The User is also obligated to promptly update his personal information in case of any changes. Without the requisite authorization from the relevant rights holders, the User is prohibited from registering a RediSail account using the name or identity of another person or entity. The User further agrees not to use misleading Account Information that could cause confusion, including but not limited to names, avatars or profile descriptions that could imply an association with a prominent public figure or organization.

4.2 In the event that the User violates the aforesaid provisions, the Platform reserves the right to take any necessary action in accordance with applicable laws, regulations and national policies, including but not limited to: rejecting registration, issuing a notice to rectify the violation within a specified period, canceling the User's account, or suspending or terminating the User’s access to the Platform services. Additionally, the Platform reserves the right to report such violations to the appropriate regulatory authorities.

4.3 The Platform will implement and maintain a comprehensive system for managing user information security, alongside technical safeguards to protect User data. The Platform will take appropriate measures to safeguard the privacy of the User’s content while using the services. However, the User is responsible for backing up any content they post or store on the Platform from time to time. During use of Platform services or following the termination or cessation of use of Platform services, the Platform has no obligation to return or provide any data or content stored by the User on the Platform.

4.4 In order to maintain the stable operation of the Platform and ensure a high-quality user experience, no individual shall, without the prior written consent of the Platform, engage in any automated behaviors or post spam on the Platform.

“Automated Behaviors” shall mean actions where the User, either independently or by authorizing a third party, employs automated means or engages in actions that substantially exceed the frequency of normal user activity. This includes, but is not limited to, the posting of RediSail content, comments, private messages, headlines, as well as activities such as following, liking or scraping data.

“Spam” shall mean marketing information, meaningless content or “buying followers” advertising posted on RediSail or in comments section or Account Information through unauthorized use of RediSail accounts (such as those obtained through fraudulent bulk registration or regular RediSail accounts) without the Platform's express permission. The User acknowledges and agrees that the Platform has the right to determine, using technical standards and verification methods, whether the User's account behavior constitute “automated behavior” or if the content posted by the User qualifies as “spam”. If such behavior is identified, the Platform reserves the right to take appropriate corrective action. All measures will be based on data and information recorded by the Platform’s backend systems, including but not limited to account operation records, content, reposts, comments and likes.

4.5 The User understands and agrees that since RediSail services are provided based on the account details supplied by the User during registration, the User is prohibited from transferring, leasing or lending his account or password to any third party. In the event that the User discovers unauthorized use of his account or the Platform services, he shall promptly notify the Platform. The Platform accepts no responsibility for any unauthorized access of RediSail account, password or services arising from hacking, the User’s negligence in securing his account or other reasons not attributable to the Platform.

4.6 The User acknowledges and agrees that, during the provision of services, the Platform may display commercial advertisements or other types of commercial communications (including, but not limited to, ads placed on any page of the Platform). Furthermore, the User consents to receiving promotional content or other commercial communications from the Platform via email, private messages or other means.

4.7 The User grants RediSail and its affiliated entities a worldwide, royalty-free and transferable license to use any content the User posts on the Platform, including but not limited to text, images and videos.

4.8 While accessing and using RediSail services, the User agrees to engage respectfully and respect the personal rights such as the rights of personality and identity of other Users in accordance with applicable laws. The User agrees to contribute to maintaining a harmonious, civil and respectful online social networking environment.

4.9 While using the RediSail services, the User shall adhere to the following principles:

The User shall not violate the laws and regulations of the People's Republic of China, nor any applicable international treaties or agreements.

The User shall comply with all relevant Internet protocols, terms of use, procedures and industry standards governing online services and the use of the RediSail services.

The User shall not engage in any activity that violates the “Seven Fundamental Guidelines”, which include laws and regulations, the socialist system, national interests, the lawful rights and interests of citizens, public order, social morality, and the authenticity of information.

The User shall refrain from any conduct that may negatively affect the normal operation of the Internet or mobile networks.

The User shall not upload, publish or disseminate any false, misleading, fraudulent, harassing, defamatory, offensive, abusive, threatening, racially discriminatory, libelous, privacy-violating, pornographic, plagiaristic content or any other unlawful information or materials.

The User shall not, by any means, infringe upon any intellectual property rights of others, including but not limited to patents, copyrights, trademarks, or personal rights such as the right to one's name, reputation, honor, portrait, privacy, or any other legal rights.

The User shall not, by any means, engage in activities that infringe upon the legitimate rights of individuals, social organizations, businesses or public institutions, including but not limited to insulating, slandering and abusing individuals or damaging the goodwill or reputation of social organizations, businesses or public institutions.

The User shall not, by any means, engage in actions that damage the image or reputation of governmental entities or agencies at any level.

The User shall not, by any means, damage the reputation, goodwill or legal rights of RediSail or its affiliates;

The User shall not engage in any activity that disrupts the normal operation of the Platform, undermines its business model, or harms the Platform’s ecosystem.

The User shall not use the RediSail services for any illegal purpose.

4.10 For certain specific RediSail services, the Platform may, through various methods (including but not limited to web announcements, system notifications, private messages and SMS alerts), provide announcements, notifications and warnings. Such communications shall be deemed an integral part of this Policy, and by using these services, the User agrees to be bound by the content of such announcements, notifications and warnings.

4.11 The Platform reserves the right to review, monitor and take appropriate actions regarding the User's activities and information while using the RediSail services, including but not limited to user information (e.g. account details, personal information, etc.), posted content (location, text, images, audio, video, trademarks, patents, publications, etc.), and user behavior (e.g., building relationships, sharing information, commenting, sending private messages, participating in activities, publishing marketing content, filing complaints, etc.).

5.1 RediSail holds exclusive ownership of the Platform itself, as well as all associated intellectual property rights in relation to RediSail products.

5.2 “RediSail products” shall mean the suite of features, software and services made available on the Platform to the User by RediSail, its affiliates or any authorized entities. These include, but are not limited to, information dissemination, relationship-building tools, auxiliary features, platform applications and public-facing platforms.

5.3 RediSail is the exclusive owner of all intellectual property rights in the content provided through the Platform and RediSail products. Such content includes, without limitation, program code, interface designs, layout frameworks, data, user accounts, text, images, graphics, charts, audio, video and any other materials, excluding content for which the relevant intellectual property rights are held by third parties in accordance with applicable laws and regulations.

5.4 The User acknowledges that he may, in the course of using the Platform, access features, software or services developed by third parties for the RediSail services. In addition to complying with the provisions of this Policy, the User agrees to adhere to the relevant terms and conditions imposed by these third parties and to respect the intellectual property rights of third-party right holders pertaining to their features, software, services and associated content.

6.1 RediSail is committed to complying with internationally recognized privacy protection standards, including, but not limited to, the European Union’s General Data Protection Regulation (GDPR). For users located within the European Union, RediSail will ensure the protection of their data rights, including the right to access, the right to deletion, and the right to data portability.

6.2 Protecting the User’s privacy and personal information is a core policy of the Platform. The Platform guarantees that it will not use individual users' registration details or any non-public content stored on the Platform during the use of RediSail services for any unlawful purposes. Additionally, the Platform will not use individual users’ registration information for commercial purposes without obtaining prior consent, except in the following circumstances:

Explicit prior authorization has been obtained from the User;

It is for safeguarding public interests;

It is required for academic research or statistical purposes by educational or research institutions, where such usage is in the public interest, with the User's written consent, and the information cannot be used to identify specific users;

The information is voluntarily disclosed by the User on the Internet or has been legally made public;

The personal data is acquired through lawful means;

The User infringes upon the legitimate rights and interests of RediSail and its affiliates, and the information is used to the extent necessary to protect such rights;

Where as required by competent government authorities;

Where as required by applicable laws, regulations or policies;

Any other circumstances deemed necessary by RediSail.

7.1 By registering and using RediSail services, the User explicitly consents to the collection and use of his personal information. Consent may be given by the User via actions such as checking the “Agree” box or clicking the “Agree” button. The User reserves the right to withdraw his consent at any time.

7.2 Types of Information We Collect: To provide access to our website and services, we will collect personal and user information to the extent permitted by laws. This collection will occur only when you browse our website, utilize specific features or engage with our services, as outlined in this Policy. Failure to provide the requested information may result in our inability to offer certain products or services.

7.3 Information Provided by You: During the use of our website and services, we may prompt you to register for a RediSail account to fully leverage our website and its associated services and benefits. When registering for a RediSail account, you will be required to provide identifiable information, such as your account name, mobile phone number and any other details required for account creation. And we will collect such information provided by you.

7.4 Device Information: When you access our services via a mobile device, we may collect information related to your device. This includes, but is not limited to, the International Mobile Equipment Identity (IMEI), advertising identifiers (IDFA and IDFV), Integrated Circuit Card Identifier (ICCID), Media Access Control (MAC) address, device model and device resolution. Such information is utilized to track device usage statistics and perform device model analysis and graphical adaptation.

7.5 Network Information: When you access our services while connected to a network, we may collect data regarding your network operator and network type to assess user distribution across different networks. Additionally, we may collect Wi-Fi network names and connection timestamps to better understand your service usage scenarios.

7.6 Log Information: As part of certain services, including the generation, participation and viewing of content, we may automatically collect relevant log data from the Platform. This includes: (1) Details regarding user interaction time and frequency; (2) Device statistics, key operation paths, error logs, crash records, language preferences and time zone information. This data is used to optimize and improve our services and is not intended to identify individual users.

7.7 Graphical Information: When you elect to use the profile picture feature, we will request permission to access your photo album to facilitate the uploading of your chosen image as an avatar. This allows us to fulfill your request for a personalized avatar display.

7.8 Metadata: Metadata refers to technical data associated with user-generated content. Put simply, metadata is data that describes other data. In the ordinary course, such metadata does not identify any specific individual. This metadata is collected solely for the purpose of improving our services and is not intended to identify any specific person.

7.9 Note Display Information: Our platform provides a public note display service. You acknowledge that by publicly posting content within the Platform, any registered user may read, collect or use your information. You may delete your posts or opt for the “Visible Only to Me” setting within the Platform. If you are unable to remove your personal information from the community forum, please contact us at 0592-5689577. In some circumstances, we may be unable to remove your personal information. In such cases, we will inform you of the reasons why this cannot be accomplished.

7.10 Cookie: In connection with your use of our website, RediSail or its authorized third-party partners may employ technologies such as cookies, tags and scripts which collect log file data and cache information. These technologies are used for analyzing trends, managing the website, tracking user activity and gathering demographic data across the entire user base. Log file data may include your IP address, browser type, ISP (Internet Service Provider), referring/exit pages, operating system, timestamps and clickstream data.

7.11 Advertising Information: We may display advertisements within our services and, for the purpose of tracking ad performance, we may collect and use information about you, including but not limited to your device identifiers, MAC address, IMEI, geographical location and IP address. This information is used to generate internal user identifiers, which help us track and analyze advertising performance based on language, location and other criteria. We will not sell this information to any third party.

7.12 Information Collected by Third-Party Service Providers: Our services may include third-party tracking tools provided by our service partners. These third parties may use cookies, APIs (Application Programming Interfaces) and SDKs (Software Development Kits) to collect and analyze user information on our behalf. These third parties may access information such as your device identifiers, MAC (Media Access Control) address, IMEI (International Mobile Equipment Identity), region-specific (specific location using a given language) data, geographic location and IP address in accordance with their respective privacy policies. Push Notification Services: RediSail account and device information may be used for delivering push notifications, evaluating the effectiveness of advertisements, and notifying you of software updates or new product launches. You may opt-out of these notifications at any time by adjusting your preferences under the “Settings” option. 

User Identity Verification: SMS verification may be employed during account login to ensure unauthorized individuals are prevented from accessing your account.

Collection of User Feedback: Your feedback is critical to helping RediSail enhance its services. To facilitate tracking and addressing your feedback, RediSail may use your provided personal information to contact you and maintain a record of your input. 

Other Purposes: To store and retain information relevant to you for our operational purposes or in order to fulfill legal obligations.

7.16 RediSail may share user information with third-party partners in order to enhance the services provided. These third parties may include, but are not limited to, advertisers, data analytics firms and cloud service providers. RediSail will ensure that all third parties adhere to strict data protection standards and will only use user information to the extent necessary to fulfill the intended purpose. Furthermore, RediSail may share and/or disclose all or part of your personal information to third parties under the following circumstances:

To protect the personal safety or property of others;

To prevent or mitigate network fraud;

To protect RediSail's legal rights and interests; 

For the purposes outlined in the “Types of Information We Collect” section, provided that the recipient of such disclosure is bound by this Policy and offers adequate protection for the information shared;

In compliance with applicable laws, regulations, or in response to requests from government authorities or judicial bodies. Such disclosures are generally made to protect network security and the rights, property and safety of RediSail, its users and third parties.

7.17 Information Security: RediSail employs reasonable safeguards to protect information from loss, misuse, unauthorized access or disclosure. For example, encryption technologies (such as SSL) may be used in certain services to safeguard your personal information. However, it is important to note that, despite our best efforts to implement robust security measures, we cannot guarantee absolute security of information within the Internet environment. You acknowledge that the systems and communication networks you use to access our services may experience issues arising from factors beyond our control.

7.18 Access to and Control of Information: RediSail will take all reasonable and appropriate technical measures to ensure that you have access to, and can update or correct, your personal information or other information provided in the course of using our services. To access, update, correct or delete such information, we may require identity verification in order to ensure the security of your account.

8.1 The User shall comply with all applicable laws, regulations and policies while using RediSail services. And the User shall be held solely liable for any consequences arising from use of the services.

8.2 Any content posted via RediSail services or any opinions expressed through RediSail services do not represent the views of RediSail. RediSail assumes no responsibility for the completeness, accuracy, reliability or truthfulness of such content. The User is solely responsible for evaluating any content they may encounter that is potentially illegal, unethical, erroneous or otherwise inappropriate, as well as any misleading, deceptive or harmful content. RediSail shall not be liable for any losses or damages incurred due to errors, omissions or the use of information posted, transmitted or otherwise disseminated through RediSail services, whether by direct message, content sharing or other means.

8.3 RediSail does not control the content of external links. Consequently, RediSail does not guarantee the accuracy or completeness of any external links provided for user convenience.

8.4 RediSail shall not be liable for any service disruptions or other defects caused by Force Majeure events or factors beyond RediSail's control. Nevertheless, RediSail will make reasonable efforts to minimize any disruption or harm caused to the User as a result of such events.

8.5 The User acknowledges and agrees that RediSail shall bear no liability for any quality defects or related losses arising from the following products or services provided to the User:

The RediSail services provided to the User free of charge;

Any products or services offered by RediSail as complimentary to the User;

Products or services provided to the User of paid RediSail services, included as part of a promotional offer.

8.6 The User further acknowledges and agrees that RediSail Platform may collaborate with third-party providers to offer certain products and services (including but not limited to third-party platforms and applications) to the User. These third parties will be responsible for the delivery of related services, such as product upgrades, maintenance and customer support. In such cases, the third-party provider shall assume full responsibility for any disputes or losses arising from the quality of such products or services. The User agrees to assert all claims related to these products and services directly with the third-party provider.

9.1 In the event that RediSail violates applicable laws, regulations or any provision of this Policy, and such violation results in losses to the User, RediSail agrees to indemnify the User for such damages in accordance with the terms of this Policy.

9.2 The User agrees to defend, indemnify and hold harmless RediSail, its affiliates and other users against any losses arising from the User's breach of applicable laws, regulations or provisions under this Policy.

9.3 Should RediSail, upon discovery or receipt of reports or complaints from third parties, determine that the User has breached or is suspected of breaching any provisions of this Policy (including, but not limited to, Section 1 “Special Notice” or Section 4 “Terms of Use”), RediSail or its authorized entities reserve the right, in its sole discretion and without prior notice, to take all necessary actions to mitigate or eliminate any adverse effects caused by the User's conduct. RediSail will notify the User as soon as practicable after the matter has been addressed. The User will bear all responsibility for any losses or consequences resulting therefrom.

9.4 Unless otherwise expressly provided herein, if RediSail discovers or is made aware (through third-party reports or complaints) of any violation or potential violation by the User of the obligations, warranties, representations or any other provisions set forth herein, the User shall, within the time frame specified by RediSail, take corrective action to remedy such violation and mitigate its effects. Should the User fail to rectify the violation within the prescribed period, RediSail or its authorized entities are entitled, at their sole discretion and without prior notice, to take all necessary actions to mitigate or eliminate any adverse effects caused by the User's conduct. RediSail will notify the User as soon as practicable after the matter has been addressed. The User will bear all responsibility for any losses or consequences resulting therefrom.

10.1 RediSail reserves the right to amend or modify any provision of this Policy at its sole discretion. Any modifications to this Policy shall be published on the RediSail website, and RediSail may also notify the User of such modifications via other appropriate means, including system notifications.

11.1 All notices under this Policy sent from the Platform to the User may be delivered through announcements, emails, system notifications, direct contact via the Platform's management account, private messages, SMS or conventional mail. Such notices shall be deemed to have been duly served on the recipient on the date of dispatch.

12.1 This Policy, including its execution and interpretation, as well as the resolution of any disputes arising hereunder shall be governed by the laws of the People's Republic of China (mainland) and shall be subject to the exclusive jurisdiction of the courts located in mainland China.

13.1 Both the Chinese and English versions of this Policy shall be equally binding and enforceable. In the event of any discrepancy between the Chinese and English versions, the Chinese version shall prevail.

13.2 This Policy constitutes the entire and exclusive understanding between the Parties with respect to the subject matter hereof and other relevant matters. No other rights or obligations are conferred upon the Parties except as expressly set forth herein.

13.3 If any provision of this Policy is deemed invalid or unenforceable, in whole or in part, for any reason, the remaining provisions shall continue in full force and effect.
